1-800 CONTACTS Files Legal Action Against Coastal Contacts

DRAPER, Utah, March 18 /PRNewswire-FirstCall/ -- 1-800 CONTACTS (Nasdaq: CTAC - News) filed legal action today in the United States Federal Court for the District of Utah against Coastal Contacts for Trademark Infringement, Unfair Competition, Trademark Dilution, Copyright infringement, Unfair Trade Practices and other related claims. The Company does not believe the legal costs related to this action will have a material impact on its financial results.

The lawsuit specifically alleges that Coastal Contacts has caused thousands of unauthorized "pop-up" advertisements to appear on 1-800 CONTACTS' website (1800contacts.com). This action is similar to litigation the Company brought against another online competitor for its use of content specific advertisements and links to its website which were triggered off of the copyrights and trademarks found on 1-800 CONTACTS' website. The judge in that action has issued a preliminary injunction against the online competitor and the advertiser for this type of advertising.
The action against Coastal Contacts has been initiated to ensure that the Company is afforded fair and reasonable use of its intellectual property. Joe Zeidner, 1-800 CONTACTS' general counsel, said "We are seeking an end to the hijacking of our website, damages for the customers inappropriately taken by Coastal Contacts, and attorneys fees."
